Agreement to our legal terms

We operate PDFComet (operated by an individual based in Georgia; "Company," "we," "us," or "our"), including the website https://pdfcomet.com (the "Site") and any related products and services that link to these terms (collectively, the "Services").

PDFComet is a free online tool that converts files (Word, PowerPoint, JPG, PNG, etc.) to PDF. No account, signup, or payment is required. Uploaded files are processed automatically and deleted within about 20 minutes; we do not read, store, or share them.

These Legal Terms constitute a legally binding agreement between you and us concerning your use of the Services. By accessing the Services, you agree that you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.

We may make changes to these Legal Terms from time to time. We will alert you by updating the "Last updated" date, and you waive any right to receive specific notice of each change. Your continued use of the Services after revised Legal Terms are posted means you accept the changes.

The Services are intended for users who are at least 18 years old. Persons under 18 are not permitted to use the Services.

1. Our services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction where such use would be contrary to law or would subject us to any registration requirement. Those who access the Services from other locations do so on their own initiative and are responsible for compliance with local laws.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, GLBA, etc.), so if your interactions would be subject to such laws, you may not use the Services.

2. Intellectual property rights

Our intellectual property

We own or license all intellectual property rights in the Services, including the source code, software, website design, text, and graphics (the "Content") and the trademarks and logos (the "Marks"). These are protected by copyright and trademark laws. The Content and Marks are provided "AS IS" for your personal, non-commercial use only.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable licence to access the Services and use them for their intended purpose (converting your files). Except as permitted here, no part of the Services, Content, or Marks may be copied, reproduced, republished, sold, or otherwise exploited for any commercial purpose without our prior written permission. We reserve all rights not expressly granted to you.

Feedback you send us

If you send us any question, comment, suggestion, idea, or other feedback about the Services ("Submissions"), you agree that we may use it without restriction or compensation to you. This does not apply to the files you upload, which are covered below.

3. User representations

By using the Services, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside (and are at least 18); (3) you will not access the Services through automated or non-human means; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use will not violate any applicable law or regulation.

If you provide information that is untrue or incomplete, or if you breach these Legal Terms, we have the right to suspend or terminate your access and refuse any current or future use of the Services.

4. Prohibited activities

You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:

Systematically retrieve data or content from the Services to build a collection, database, or directory without our written permission.
Trick, defraud, or mislead us or other users.
Circumvent, disable, or interfere with security-related features of the Services.
Use any information from the Services to harass, abuse, or harm another person.
Make improper use of our support services or submit false reports of abuse.
Use the Services in a manner inconsistent with any applicable law or regulation.
Upload or transmit viruses, Trojan horses, or other material that disrupts the Services.
Engage in any automated use of the system, or use any data-mining, robots, or scraping tools.
Interfere with, disrupt, or create an undue burden on the Services or connected networks.
Attempt to bypass measures designed to prevent or restrict access to the Services.
Except as permitted by law, decompile, disassemble, or reverse engineer any of the software.
Upload, convert, or distribute any file that is illegal, infringes intellectual property or privacy rights, or that you do not have the necessary rights to use.
Upload files containing malware, viruses, or any malicious or harmful code.
Attempt to circumvent, overload, disrupt, or abuse the Services' security measures, rate limits, or bot protection, including through automated, scripted, or bulk use.
Use the Services to unlawfully process the personal or sensitive data of other people.

5. Your files and content

The main content you provide is the file you upload for conversion. Your files areprivate: they are processed only to perform the conversion you request, are never published or made viewable to other users, and are automatically deleted within about 20 minutes (see "Files and conversions"). When you upload a file, you represent and warrant that:

You are the owner of, or have all necessary rights, licences, and permissions to use and convert, the file.
The file and its conversion do not and will not infringe the intellectual property, privacy, or publicity rights of any third party.
The file does not contain material that is illegal or that violates any applicable law or regulation, including laws protecting minors.
The file does not contain malware or other harmful code, and does not violate the "Prohibited activities" section above.

Any use of the Services in violation of the foregoing may result in termination or suspension of your access.

6. Licence to your files

You retain all ownership of and rights to the files you upload. You grant us only a limited, non-exclusive, worldwide, royalty-free licence to store, process, and convert your file, and to return the resulting PDF to you, solely to provide the Services — and only for as long as the file exists on our systems (about 20 minutes), after which it is deleted. We donot sell, publish, display, share, or otherwise use your files for any other purpose, and we claim no ownership over them.

7. Third-party websites and content

The Services may link to third-party websites or contain third-party content that we do not investigate or monitor. We are not responsible for the content, accuracy, or privacy practices of any third-party websites or content, and their inclusion does not imply our endorsement. If you access third-party websites or content, you do so at your own risk and should review their terms and policies. Any purchases or dealings you have with third parties are solely between you and them.

8. Advertisers

When advertising is enabled on the Services, we may allow advertisers to display advertisements in certain areas, such as banner advertisements. We simply provide the space to place such advertisements, and we have no other relationship with advertisers.

9. Services management

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict, or disable access to the Services or stop processing any file that is excessive in size or burdensome to our systems; and (4) otherwise manage the Services to protect our rights and property and facilitate their proper functioning.

10. Privacy policy

We care about data privacy and security. Please review our Privacy Policy. By using the Services, you agree to be bound by it. The Services are hosted in the United States. If you access them from another region, you understand that your data is transferred to and processed in the United States, and you consent to that transfer.

11. Copyright infringements

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes a copyright you own or control, please notify us at[email protected]. Please be advised that under applicable law you may be held liable for damages if you make a material misrepresentation in such a notice, so if you are unsure whether material infringes your copyright you should consider contacting an attorney.

12. Term and termination

These Legal Terms remain in effect while you use the Services. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Services (including blocking certain IP addresses) to any person for any reason, including for breach of these Legal Terms or any applicable law. We may also stop processing or delete any file at any time. We reserve the right to take appropriate legal action, including pursuing civil or injunctive remedies.

13. Modifications and interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time, at our sole discretion and without notice. We have no obligation to update any information. We cannot guarantee the Services will be available at all times; we may experience problems or perform maintenance resulting in interruptions, delays, or errors. You agree that we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance. Nothing in these Legal Terms obligates us to maintain or support the Services.

14. Governing law

These Legal Terms are governed by and construed in accordance with the laws of Georgia. You and we irrevocably consent that the courts of Georgia shall have exclusive jurisdiction to resolve any dispute arising in connection with these Legal Terms.

15. Dispute resolution

You agree to irrevocably submit all disputes related to these Legal Terms to the jurisdiction of the courts of Georgia. We also retain the right to bring proceedings in the courts of the country where you reside or, if these Legal Terms are entered into in the course of your trade or profession, your principal place of business.

16. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update the information at any time, without prior notice.

17. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES OR ANY LINKED CONTENT, AND WE ASSUME NO LIABILITY FOR (1) ERRORS OR INACCURACIES OF CONTENT, (2) PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM YOUR USE OF THE SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OUR SERVERS OR ANY INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OF TRANSMISSION TO OR FROM THE SERVICES, (5) ANY BUGS, VIRUSES, OR THE LIKE TRANSMITTED THROUGH THE SERVICES BY ANY THIRD PARTY, OR (6) ANY LOSS OR DAMAGE INCURRED FROM THE USE OF THE SERVICES. YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

18. Limitations of liability

IN NO EVENT WILL WE OR OUR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION WILL AT ALL TIMES BE LIMITED TO $50.00 USD. CERTAIN US STATE AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OF CERTAIN DAMAGES; IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

19. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party arising out of: (1) your use of the Services; (2) your breach of these Legal Terms; (3) any breach of your representations and warranties; (4) your violation of the rights of a third party, including intellectual property rights; or (5) any harmful act toward another user. We reserve the right, at your expense, to assume the exclusive defense of any such matter, and you agree to cooperate. We will use reasonable efforts to notify you of any such claim.

20. User data

We do not retain the files you convert: both the file you upload and the PDF we create are automatically deleted within about 20 minutes, and we keep no backups of them. You are solely responsible for keeping your own copies of your files and their output. You agree that we have no liability to you for any loss or corruption of files or data, and you waive any right of action against us arising from any such loss.

21. Electronic communications, transactions, and signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree to the use of electronic signatures and records, and waive any rights requiring an original (non-electronic) signature or record.

22. California users and residents

If any complaint with us is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

23. Miscellaneous

These Legal Terms and any policies posted by us constitute the entire agreement between you and us. Our failure to exercise or enforce any right or provision shall not operate as a waiver. We may assign our rights and obligations at any time. We are not responsible for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision is determined to be unlawful or unenforceable, that provision is deemed severable and does not affect the remaining provisions. No joint venture, partnership, or agency relationship is created by these Legal Terms. You agree these Legal Terms will not be construed against us by virtue of having drafted them.

24. Files and conversions

PDFComet is a free tool, and conversions are provided "as is." Conversion results may vary and formatting may differ from the original, so you are responsible for reviewing the output and confirming it meets your needs. Both the file you upload and the PDF we create are automatically deleted within about 20 minutes and cannot be recovered — please download your PDF promptly and keep your own copies. We keep no copies of your files and cannot restore or re-send them. You retain all rights to your files; you grant us only a limited licence to process and convert them solely to provide the service, after which they are deleted.
